01 Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of this website describing new-construction homes in Nesconset, NY and the surrounding Long Island area (the "Site"), operated by Emlak Realty ("Emlak Realty," "we," "us," or "our"). By accessing or using the Site, submitting a form, or booking a consultation, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.
02 Purpose of this Site
The Site is provided for general informational and marketing purposes to help prospective buyers learn about available homesites, floor plans, standard and upgrade options, and the general new-construction process, and to submit inquiries or book a consultation. The Site does not itself facilitate the sale of property, process payments, or create any binding contract for the purchase of a home. Any purchase of a home is governed exclusively by a separate, signed written purchase agreement between you and Emlak Realty (or the applicable seller of record).

Content on the Site — including the mortgage/payment calculator, upgrade cost estimator, financing FAQ, and general commentary about construction loans, credit scores, or down payments — is provided for illustration and general information only. It does not constitute financial, mortgage, legal, tax, or real estate advice, and is not a loan offer, pre-approval, or commitment to lend. You should speak with a licensed loan officer, attorney, or other qualified professional regarding your specific situation before making any financial or purchasing decision.
04 Pricing, plans & availability
Prices, plans, dimensions, features, specifications, materials, and availability described on the Site are subject to change without notice. Square footage is approximate and may vary from the final constructed home. Renderings and floor plans are artist's concepts and are not to scale. Homesite availability, incentives, and pricing are not guaranteed until confirmed in a signed purchase agreement.
05 Your submissions & consent to contact
When you submit a form on the Site, you confirm that the information you provide is accurate and that you are the owner or authorized user of the phone number and email address you submit. If you check the consent checkbox on a form, you agree that we may contact you by phone, text message, and email — including using automated technology — about available homes and your inquiry, as described in our Privacy Policy. You can withdraw this consent at any time using the methods described there.
06 Acceptable use
When using the Site, you agree not to:
- Submit false, misleading, or fraudulent information through any form;
- Attempt to gain unauthorized access to the Site, its underlying systems, or another user's information;
- Interfere with or disrupt the Site's operation, including through malicious code, scraping at a disruptive volume, or denial-of-service techniques;
- Use the Site to transmit unsolicited advertising, spam, or unlawful content; or
- Use the Site in a manner that violates any applicable law or regulation.

You may view and share pages of the Site for personal, non-commercial use, but may not reproduce, distribute, modify, or create derivative works from the Site's content without our prior written permission.

The Site contains links to third-party websites and social media platforms, including Facebook, LinkedIn, X, Instagram, YouTube, TikTok, Pinterest, Snapchat, Zillow, Yelp, and Google Maps. You agree to indemnify and hold Emlak Realty and its owners, employees, and agents harmless from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
13 Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Suffolk County, New York, and you consent to the personal jurisdiction of those courts.
14 Changes to these terms
We may update these Terms from time to time. Changes are effective when posted to this page with a revised "Last updated" date. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
